Terms and refunds

Ombra is run by Ombra Trading Ltd (company 17531482), registered in England and Wales, registered office 71-75 Shelton Street, London WC2H 9JQ. Email: craig@ombratrading.com. Postal address: available on request by email.

• The Ombra Watch add-on for NinjaTrader 8, and updates to it while you subscribe.
• The email alert service: our relay emails the address linked to your install code when Watch raises or resolves an alert.
• Help by email, usually within one working day.

One subscription covers one NinjaTrader 8 install, with any number of accounts and groups on it. The add-on’s source code is published under an open-source licence (MIT), which governs the software itself. Your subscription pays for the alert service, updates and support.

• It’s a read-only alarm. It never places, changes or cancels orders, and it can’t fix a problem for you.
• It only sees accounts connected in the NinjaTrader 8 it runs in, and only while NinjaTrader is running and connected.
• Email depends on your internet connection, our relay, our email provider and your inbox, and can be delayed or blocked. Watch’s on-screen alarm doesn’t depend on any of these.
• It’s not trading advice, a signal service, a broker or a prop firm. You stay responsible for your trading, your stops, and following your prop firm’s rules.

• Ombra Watch is $19 a month, plus VAT or sales tax where it applies, charged on the day you subscribe and on the same date each month after that, until you cancel. Your bank may add a currency conversion fee.
• Ombra Watch checkout and billing are handled by Stripe, which sells the subscription to you as our reseller (merchant of record) and collects any tax due. Stripe’s checkout terms apply to the payment itself. Your receipt comes from Stripe.
• We’ll email you before we change the price, at least 30 days ahead. You can cancel before the new price applies.
• Cancel any time from your billing page (sign in with the email you subscribed with), or by emailing us. Cancelling stops future payments. Your subscription runs to the end of the month you’ve paid for, then the alert service stops for your install code.

If you’re not happy for any reason, email us within 14 days of your first payment and we’ll refund it in full. You don’t need to give a reason, and that applies even though you’ve downloaded the add-on. We usually refund within 5 working days, to the card you paid with. After the first 14 days, payments already made aren’t refunded, except where the law says they must be or where the service hasn’t worked and we can’t fix it.

Each install code is for one person’s own install. Please don’t share it or use the relay to send anything other than Ombra Watch alerts. The relay sends at most 30 emails per code per hour, so a fault can’t flood your inbox. We may suspend a code that’s being misused, and will tell you why.

We’ll provide the service with reasonable care and skill. Trading carries a high risk of loss, and Ombra Watch is a tool to help you notice problems, not a guarantee against them. So, as far as the law allows, we aren’t responsible for trading losses, missed alerts, or losses caused by your copier, your broker, your prop firm, NinjaTrader or your internet connection. Our total responsibility to you is limited to the amount you’ve paid us in the 12 months before the problem.

Nothing in these terms limits your legal rights as a consumer, or our responsibility for death or personal injury caused by negligence, or for fraud.

If you are buying an indicator or strategy from the Ombra Shop, the Ombra Shop terms apply to your purchase and form part of these terms. In short:

• Seller. Craig Shuttleworth, trading as Ombra Trading, sole trader. Stripe only processes the payment for Shop purchases; it is not the reseller.
• What you get. Access to the script on TradingView, as an invite-only script, for the TradingView username you give at checkout, added within 24 hours on UK working days.
• Your 14-day right to cancel. You can cancel within 14 days for a full refund. If you ask at checkout for access to start straight away, the right to cancel ends once access is given.
• Not financial advice. Strategy results are hypothetical. Full details are in the Ombra Shop terms.

The privacy notice explains what we hold and why. In short: your email address, your Stripe billing record, and the alert details listed there. Never prices or market data, and never shared with prop firms.

If we change these terms, we’ll email subscribers at least 30 days ahead, and you can cancel before the change applies. If something goes wrong, email us first and we’ll try to put it right. These terms are governed by the law of England and Wales, and you can bring a claim in the courts where you live in the UK.
